BackgroundThe landscape of clinical research has evolved over the past decade. With technological advances, the practice of using electronic informed consent (eIC) has emerged. However, a number of challenges hinder the successful and widespread deployment of eIC in clinical research. Therefore, we aimed to investigate the views of various stakeholders on the potential advantages and challenges of eIC.MethodsSemi-structured interviews were conducted with 39 participants from 5 stakeholder groups from across 11 European countries. The stakeholder groups included physicians, patient organization representatives, (...) regulator representatives, ethics committee members, and pharmaceutical industry representatives, and all were involved in clinical research. Interviews were analyzed using the framework method.ResultsInterviewees identified that a powerful feature of eIC is its personalized approach as it may increase participant empowerment. However, they identified several ethical and practical challenges, such as ensuring research participants are not overloaded with information and offering the same options to research participants who would prefer a paper-based informed consent rather than eIC. According to the interviewees, eIC has the potential to establish efficient long-term interactions between the research participants and the research team in order to keep the participants informed during and after the study. Interviewees emphasized that a personal interaction with the research team is of utmost importance and this cannot be replaced by an electronic platform. In addition, interviewees across the stakeholder groups supported the idea of having a harmonized eIC approach across the European Member States.ConclusionsInterviewees reported a range of design and implementation challenges which needs to be overcome to foster innovation in informing research participants and obtaining their consent electronically. It was considered important that the implementation of eIC runs alongside the face-to-face contact between research participants and the research team. Moreover, interviewees expect that eIC could offer the opportunity to enable a personalized approach and to strengthen continuous communication over time. If successfully implemented, eIC may facilitate the engagement of research participants in clinical research. (shrink)

Why law may be less important than we think.

Are we to get rid with representation after all? Since World War II, political philosophy seems to have devoted itself to either the intellectual sabotage of representation, or its defence against all evidence. Nobody seems to have thought that the problem with political representation might be the fact that the way it was thought was by no means correct. Considered as a fundamental principle of Western democracies, it might be at the very level of what a principle implies that representation (...) must be reloaded. For instance, by admitting that as a principle representation is not something that precedes what for which it provides ground (the government, the State, etc.)—but something that follows, that constitutes the final product of representation itself. Rationale In Belgium, several policies regulating reimbursement of acid suppressant drugs and evidence-based recommendations for clinical practice were issued in a short period of time, creating a unique opportunity to observe their effect on prescribing. Aims and objectives To describe the evolution of prescriptions for acid suppressants and explore the interaction of policies and practice recommendations with prescribing patterns. Method Monthly claims-based data for proton pump inhibitors (PPIs) and H-2-antihistamines by general practitioners, internists and "astroenterologists were obtained from the Belgian (...) national health insurance database (1997-2005). The evolution of reimbursed defined daily doses and expenses after introduction of reimbursement regulations and dissemination of practice recommendations was explored. Results Recommendations had no impact on prescribing. All changes can be related to concomitant policies. Lifting reimbursement restrictions for cheaper products did not control growth or save costs in the Iona term. Only restricting reimbursement of all PPIs managed to curb the growth. We observed an unintended increase of non-omeprazole PPIs by gastroenterologists. Conclusions Reimbursement policies influence prescribing, but their effect can be unintended. A dialogue between policymakers and guideline developers, and evidence-based policies that are linked to clinical guidelines, could be an effective way to pursue both cost-containment and quality of care. Over the past decades, the modernization of agriculture in the Western world has contributed not only to a rapid increase in food production but also to environmental and societal concerns over issues such as greenhouse gas emissions, soil quality and biodiversity loss. Many of these concerns, for example those related to animal welfare or labor conditions, are stuck in controversies and apparently deadlocked debates. As a result we observe a paradox in which a wide range of corporate social responsibility initiatives, (...) originally seeking to reconnect agriculture and society, frequently provoke debate, conflict, and protests. In order to make sense of this pattern, the present paper contends that Western agriculture is marked by moral complexity, i.e., the tendency of multiple legitimate moral standpoints to proliferate without the realistic prospect of a consensus. This contention is buttressed by a conceptual framework that draws inspiration the contemporary business ethics and systems-theoretic scholarship. From the systems-theoretic point of view, the evolution of moral complexity is traced back to the processes of agricultural modernization, specialization, and differentiation, each of which suppresses the responsiveness of the economic and legal institutions to the full range of societal and environmental concerns about agriculture. From the business ethics point of view, moral complexity is shown to prevent the transformation of the ethical responsibilities into the legal and economic responsibilities despite the ongoing institutionalization of CSR. Navigating moral complexity is shown to require moral judgments which are necessarily personal and contestable. These judgments are implicated in those CSR initiatives that require dealing with trade-offs among the different sustainability issues. (shrink)

The transition towards sustainable and just food systems is ongoing, illustrated by an increasing number of initiatives that try to address unsustainable practices and social injustices. Insights are needed into what a just transition entails in order to critically engage with plural and potentially conflicting justice conceptualisations. Researchers play an active role in food system transitions, but it is unclear which conceptualisations and principles of justice they enact when writing about food system initiatives. To fill this gap this paper investigates: (...) Which conceptualisations of justice emerge from the literature related to food system initiatives and which principles of justice do authors use? We developed an initial framework for which we drew on political philosophy literature. We then undertook an extensive review of the food system transitions literature using this framework and were able to identify a range of recognition, distributive, and procedural justice conceptualisations and associated principles of justice. Recognised as subjects of justice were those with a particular role in the food system, people who are marginalised, Indigenous communities, those with experiences of negative consequences of the food system, future generations, and nonhumans. The identified conceptualisations and the developed framework can be used by those involved in food system initiatives to reflect on how they conceptualise justice. We challenge them to be more explicit about who they do and do not recognise as subjects of justice and which principles of justice they use. Such clarity is needed to reflexively enact a just transition towards sustainable and just food systems. (shrink)

During the past two decades or so, the emergence and ever-accelerating development of digital media have sparked scholarly interest, debates, and complex challenges across many disciplines in the social sciences and the humanities. Within this diverse scholarship, the research on digitality, gender, sexuality, and embodiment has contributed substantially to many academic fields, such as media studies, sociology, religion, philosophy, and education studies. As a part of the special issue “Gender, Sexuality, and Embodiment in Digital Spheres: Connecting Intersectionality and Digitality,” this (...) roundtable consists of a conversation between five researchers from different (inter)disciplinary locations, all addressing matters of methodology, intersectionality, positionality, and theory in relation to the topics of gender, sexuality, and embodiment in digital spheres. Said roundtable begins with a critical self-positioning of the participants’ (inter)disciplinary and embodied locations using examples from their own research. The conversation then progresses to how these researchers have employed contemporary theories, conceptual vocabularies, methods, and analyses of gender, sexuality, and embodiment in digital spheres to then conclude with some ethico-political notes about collaborations between scholars and (digital) activists. While the history of Thomas More as a character on stage is long and varied, the humanist made his most regular appearance in Latin school plays across Catholic Europe throughout the seventeenth and eighteenth centuries. Still, only a handful of these plays are known to have survived, all of which were performed on the Jesuit stage. This article sheds light on a newly discovered Neo-Latin More play, which, it argues, was staged at the Benedictine college of Marchiennes in the late-sixteenth (...) or early-seventeenth century. After a brief contextualization and analysis of the manuscript and the tragedy enclosed, the article offers an edition of the Latin text and a study of its intertextual ties with the dramatic oeuvres of Desiderius Erasmus and George Buchanan. Departing from the (post-)Anthropocenic crisis state of today’s world, fuelled by the ongoing COVID-19 pandemic, various post-truth populist follies, and an apocalyptic WW3-scenario that has been hanging in the air since the 2022 invasion of Ukraine, this article argues for the possibility – and necessity – of an affirmative posthumanist-materialist mapping of hope. Embedded in the Deleuzoguattarian-Braidottian (see Deleuze and Guattari 2005 [1980]; Braidotti 2011 [1994]) methodology of critical cartography, and infused with critical posthumanist, new materialist, and queer theoretical perspectives, (...) this cartography of hope is sketched out against two permacrisis-infused positionalities: nostalgic humanism and tragic (post-)humanism. Forced to navigate between these two extremes, the critical cartography of hope presented here explores hope in numerous historico-philosophical (re-)configurations: from the premodern ‘hope-as-all-too-human’, to a more politicised early modern ‘hope-as-(politically-)human’ – representing hope’s first paradigm shift (politicisation), and from a four decades-long neoliberal redrawing of hope as ‘no-more-hope’ – hope’s second shift (depoliticisation) – to a critical (new) materialist plea to de-anthropocentrise and re-politicise hope – hope’s third and final post-Anthropocenic shift (re-politicisation). By mapping these (re-)configurations of hope, a philosophical plea is made for hope as a material(ist) praxis that can help us better understand – and counter – these extractive late capitalist, neoliberal more-than-human crisis times. ZusammenfassungZumindest bei bestimmten Gruppen kann die Aneuploidietestung im Rahmen der PID für die Schwangerschaft medizinisch sinnvoll sein. Die gegenwärtige Rechtslage in Deutschland scheint die PID auf eine Chromosomenfehlverteilung im Embryo nicht auszuschließen; diese Testung muss aber im Einzelfall begründet und von der Frau bei einer PID-Ethikkommission beantragt werden. Der Artikel untersucht die Frage aus ethischer und rechtlicher Sicht, ob prinzipielle Gründe dagegen stehen, dass die zuständigen Ethikkommissionen Anträgen auf die Durchführung von Aneuploidietests zustimmen. Es können drei verschiedene Fallkonstellationen unterschieden werden, (...) in denen Aneuploidietests Teil von unterschiedlichen Handlungen werden und entsprechend unterschiedliche ethische Implikationen aufweisen: Das Ziel der IVF kann (i) der Aneuploidietest selbst sein, oder (ii) die IVF kann eine indizierte Unfruchtbarkeitsbehandlung sein, bei der man auch PID und Aneuploidietests durchführen kann, oder (iii) die PID ist indiziert zur Vermeidung einer Erbkrankheit oder Chromosomenschädigung und Aneuploidie kann in dieser Situation ein Zufalls- oder ein Zusatzbefund werden. Ethische Argumente, die grundsätzlich gegen eine Zulässigkeit von Aneuploidietests sprechen könnten, sind die Vermeidung einer Diskriminierung von Menschen mit Aneuploidien und der Embryonenschutz. Sie könnten gegen das Fallszenario (i) erhoben werden, aber nicht gegen (ii) und (iii). Es gibt aber mindestens drei ethische Argumente, die für die Zulässigkeit sprechen: die „gute Praxis“ der IVF, die Pflicht gegenüber dem entstehenden Kind und die Mitsprache des Paares. Ergebnis: Es ist aus rechtlichen und ethischen Gründen nicht ausgeschlossen und deshalb in Deutschland durch die zuständigen PID-Kommissionen offen zu diskutieren, ob Aneuploidietests in der PID möglich werden. Definition of the problemFrom an ethical point of view we analyse the ruling of the German Federal Joint Committee (Gemeinsamer Bundesausschuss, G‑BA) of September 2019 to revise the guidelines about the coverage of noninvasive prenatal tests (NIPT) by mandatory health insurance, in order to include them under specified conditions. The decision contains four essential elements: a definition of the aim of NIPT testing (to avoid invasive testing), a criterion of access (test must be “necessary” for the pregnant woman to tackle (...) her individual situation), statements about the process of decision-making (after counselling by a physician and case by case) and a normative contextualization (termination of pregnancy under § 218 a German penal law) which is to be found in its explanations. There are tensions in the proposed model that oscillate about two axes: (1) The suffering that results from a possible birth of a child with trisomy or from not knowing about the genetic condition of the fetus can ultimately only be evaluated subjectively, from the perspective of the pregnant woman. (2) The meaning of an individual decision in the case-by-case model remains unclear because when judging about individual cases general points of view also need to be considered. However, we argue that the model of the G‑BA could be a sociopolitically and ultimately also ethically defensible pragmatic solution, exactly because of its paradoxes and its inherent flexibility. Het zijn slechts een paar van de beladen termen waar we tegenwoordig veel mee geconfronteerd worden, en dat in de context van persoonlijke identiteitsvorming als in debatten omtrent groepsidentiteit, de vraag naar minderheidsrechten en de gepercipieerde conflicten met de zogenaamde democratische Westerse Verlichtingsidealen die daar vervolgens uit voortkomen. Heel veel van deze politieke discussies die momenteel gevoerd worden binnen de politiek en de media draaien om ‘identiteit’, waardoor dit concept helaas (...) tot een gepolitiseerd en polariserend begrip verworden is. Ongeveer vijf weken na de start van de jacht op Jürgen Conings, de Belgische beroepsmilitair gezocht omwille van het bedreigen van viroloog Marc Van Ranst en andere prominente doelwitten, vond men zijn stoffelijk overschot terug in het Dilserbos, Dilsen-Stokkem. Ook na zijn dood – Conings overleed hoogstwaarschijnlijk door zelfmoord – blijft de zaak Conings het Belgische sociaal-politieke landschap beroeren en de publieke opinie verdelen: de mate van steun die Conings de afgelopen weken kreeg, toont nog maar eens aan dat extreemrechts (...) een serieus maatschappelijk probleem is in België, waarvan de reikwijdte bovendien maar al te vaak miskend wordt. Die breite Einführung nicht-invasiver pränataler Tests sowie die Ausweitung der Testziele über Trisomien hinaus machen es notwendig, Sinn und Ziel der pränatalen Diagnostik als emergente soziale Praxis grundsätzlich zu diskutieren. Wenn, wie angenommen wird, PND nicht zu eugenischen Zwecken, sondern zur Stärkung der Autonomie dienen soll, muss gefragt werden, welche Bedeutung die Entscheidungen haben, ein bestimmtes zukünftiges Kind zu gebären. Stephen Wilkinson hat vorgeschlagen, PND als eine Form „selektiver Reproduktion“ zu verstehen. In diesem Paper wird geprüft, ob die Charakterisierung der (...) Entscheidung nach PND als „Selektion“ zutrifft und welche moralischen Vorannahmen ihr zugrunde liegen.Es zeigt sich, dass das Konzept der „selektiven Reproduktion“ die Handlungen der PND inakkurat repräsentiert. Es beinhaltet zudem sowohl eine Abstrahierung als auch eine Distanzierung. Es nimmt an, dass Frauen und Paare entweder falls nötig mehrere Schwangerschaften planen, um ein gesundes Kind zu erzeugen, oder sich als Ausführende einer selektiven Strategie auf der Populationsebene verstehen. Die Einschränkung der ethischen Diskussion auf das Problem der Selektion verdeckt zwei wichtige Problemfelder, die die konflikthaltige Situation der PND aus der Perspektive der Frau oder des Paares charakterisieren: die Schwangerschaft als persönliche Beziehung und den Akt des Abbruchs der Schwangerschaft. Aufgrund seiner impliziten Normativität wird „selektive Fortpflanzung“ als sinnvolle Bezeichnung für die Praxis der PND zurückgewiesen. (shrink)

Le discours officiel de l'Église catholique met volontiers en cause, depuis plusieurs années, la rationalité des Lumières sous le nom de « modernité ». La raison occidentale qui se détourne de la transcendance est accusée de conduire l'humanité à sa perte, rendue responsable de la décadence des mœurs, et de toutes les formes de totalitarisme; la Shoah serait le fruit amer d'une telle perversion.Il est vrai que les Lumières ont été dénoncées depuis longtemps sous des aspects divers, par le Romantisme, (...) par l'École de Francfort, et le sont encore par toutes les critiques adressées à la raison instrumentale. Quantum leaps happen in texts, too. This reading of the role of the quantum leap in Karen Barad's agential realism is necessary, because arguing that the diffractive reading strategy proposed by Barad's ethico-onto-epistemology mirrors the physical phenomenon of diffraction would indeed be representationalist. Reviewing how Barad—in her own oeuvre—has transformed diffraction into an innovative reading methodology that could not only potentially challenge the epistemological underpinnings of the canonization process that is at work in feminist theory, but could also radically change (...) the canonization practice of feminist oeuvres itself, our article embarks on a detailed examination of the ways in which the oeuvres of Simone de Beauvoir and Luce Irigaray have been mistakenly categorized and canonized in a hierarchical and Oedipalized manner. This conflict-based narrative has not only paralyzed the oeuvres of Irigaray and Beauvoir, but also has had a negative impact on the canonization of sexual difference philosophy as a whole in feminist theory. By (re)reading the oeuvres diffractively, this article brings the feminist philosophies of Beauvoir and Irigaray together by invalidating the idea that the feminist canonization process always has to run along the lines of discontinuity, Oedipalization and dialectization. Sinds de opmars van het Foucaultiaanse poststructuralisme – vaak opgepikt door feministische denkers die Michel Foucaults (1976) (le) pouvoir-savoir of de verstrengeling van macht en kennis wel konden appreciëren – zijn er verschillende post-poststructuralistische filosofieën bijgekomen die inzoomen op wereldlijke entiteiten en hun verhoudingen. Naast deze door Foucault opnieuw belichte verhoudingen, en de epistemologische manieren waarop wij kennis kunnen verkrijgen over de subjecten en objecten die achter deze door macht gekenmerkte relaties schuilgaan, bekritiseren deze stromingen ook een ander, door Foucault (...) aangestipt, Verlichtingsthema: het moderne antropocentrische wereld- en mensbeeld. Die allogene Transplantation von Blutstammzellen aus dem Körper von Kindern, die der Spende nicht selbst zustimmen können, in den Körper eines kranken Geschwisterkindes wirft schwierige ethische Fragen auf. Wie kann ein risikobehafteter, fremdnütziger medizinischer Eingriff ethisch gerechtfertigt werden? In dieser Arbeit werden Argumente kritisch untersucht, nach denen das Spenderkind eine Pflicht habe, bei der Transplantation mitzumachen. Die Idee der Pflicht ist nachvollziehbar aus der Perspektive der Eltern, die zwar in einem Fürsorgekonflikt sind (ein Kind zu Gunsten der Rettung des anderen (...) verletzen zu müssen), aber selbst eine Pflicht haben, für das Leben des kranken Kindes zu kämpfen. Eine Analyse des Pflichtbegriffs zeigt jedoch, dass die Erfüllung einer Pflicht daran gebunden ist, entscheidungskompetent zu sein. Drei Wege werden untersucht, eine solche Pflicht dennochzuzuschreiben: i) die Eltern übertragenihre Pflicht auf das Kind; ii) die Interessen des Spenderkindes implizieren eine Pflicht; iii) Geschwisterkinder haben aufgrund ihrer vertrauten Familienbeziehungen Pflichten untereinander, die auch die Pflicht zu spenden beinhalten. Alle drei Zuschreibungsstrategien werden als unhaltbar kritisiert. Das Ergebnis lautet, dass die Pflicht, einem Geschwisterkind Körpergewebe zu spenden, einem nicht-einwilligungsfähigen Kind nicht zugeschrieben werden kann. Andere philosophische Ansätze zur Stammzellspende von Kindern an Familienangehörige müssten entwickelt und geprüft werden. (shrink)
